Definitions

Scope of Services

Haftusaar provides website design, development, and maintenance services as outlined in the signed agreement or proposal. All deliverables, timelines, and pricing will be clearly stated in the project scope document.

Payments and Fees

• Advance Payment: A 50% advance payment of the total project cost is required before work commences.
• Final Payment: The remaining balance must be paid upon project completion and before the final handover.
• Additional Charges: Any scope changes or additional requests beyond the initial agreement will incur additional charges.

Intellectual Property

• Upon full payment, all project deliverables become the property of the client.

• Haftusaar retains the right to use the project in our portfolio or marketing materials unless otherwise agreed in writing.

• The client must ensure all content, images, and materials provided to Haftusaar for the project comply with copyright laws. Haftusaar will not be held responsible for any copyright infringement claims.

Prohibited Uses

When using Haftusaar's website and services, you agree not to

• Use the services for any unlawful purposes or activities that violate local, national, or international laws.
• Attempt to gain unauthorized access to our systems, servers, or any other part of our network infrastructure.
• Distribute viruses, malware, or any other harmful code that may damage or disrupt the functionality of our website or services.
• Engage in any activity that may harm, defame, or abuse Haftusaar, its employees, or other clients.
• Use our services to transmit, share, or host obscene, offensive, defamatory, or objectionable content.
• Misrepresent your identity or affiliation with any person or entity when engaging with Haftusaar
• Use automated tools such as bots, spiders, or scrapers to collect data from our website without our explicit permission.
• Resell, redistribute, or copy any content or services provided by Haftusaar without prior written consent.
• Interfere with the proper functioning of our services, including overloading, flooding, or disrupting our systems or networks.
• Use our services for activities that promote hatred, discrimination, or any form of harassment.

Violation of these prohibited uses may result in immediate termination of your services, and Haftusaar reserves the right to pursue legal action to the fullest extent permitted by law.

Project Timelines

• Haftusaar will deliver the project within the agreed timeline, provided all required inputs are received from the client in a timely manner.
• Delays caused by the client (e.g., delayed approvals or incomplete submissions) may result in an extension of the timeline.

Cancellations and Refunds

• Once the project is initiated, the client is not eligible for a refund under any circumstances.
• In the event of a project cancellation requested by the client, Haftusaar will retain the advance payment as compensation for time and resources allocated.

Maintenance and Support

• Maintenance and support services will be provided as per the signed agreement.
• Any additional support outside the scope of the agreement will be billed at our standard hourly rates.

Liability

• Haftusaar is not responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services.
• We are not liable for any issues caused by third-party software, hosting providers, or unforeseen technical problems.

Confidentiality

Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the project. Neither party will disclose such information to third parties without prior written consent.

Termination

Haftusaar reserves the right to terminate services if the client fails to meet their obligations, including timely payments and communication.

Governing Law

• These Terms shall be governed and construed in accordance with the laws of India, which governing law applies to agreement without regard to its conflict of law provisions.
• Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

Amendments

Haftusaar reserves the right to update or modify these Terms at any time without prior notice. Any changes will be posted on our website and will be effective immediately.
